After an 11-year legal battle, the New York Supreme Court on Friday ordered that a 1918 Modigliani painting looted by the Nazis in France be returned to the property of the Jewish art dealer who owned it, The New York Times reported.<\/p>\n
“Seated Man with a Cane,” which depicts a mustachioed figure in a suit and hat holding a cane, is worth an estimated $25 million.<\/p>\n
Judge Joel M. Cohen determined that the oil painting was the same as a work confiscated from a Paris art store by Oscar Stettiner, a British man who died in France in 1948 during the German occupation of France.<\/p>\n
In his ruling, Cohen rejected arguments to the contrary by David Nahamad, a Lebanese-born Jewish art dealer, and his International Art Center holding company, which bought the painting at auction in 1996.<\/p>\n
“Oscar Stetiner owned, or at least had superior ownership of, the painting prior to its illegal seizure,” the judge said, adding, “He never voluntarily relinquished the painting,” according to the Times.<\/p>\n
