Court orders Modigliani painting stolen by Nazis to be returned to Jewish art dealer’s property

After an 11-year legal battle, the New York Supreme Court on Friday ordered that a 1918 Modigliani painting looted by the Nazis in France be returned to the property of the Jewish art dealer who owned it, The New York Times reported.

“Seated Man with a Cane,” which depicts a mustachioed figure in a suit and hat holding a cane, is worth an estimated $25 million.

Judge Joel M. Cohen determined that the oil painting was the same as a work confiscated from a Paris art store by Oscar Stettiner, a British man who died in France in 1948 during the German occupation of France.

In his ruling, Cohen rejected arguments to the contrary by David Nahamad, a Lebanese-born Jewish art dealer, and his International Art Center holding company, which bought the painting at auction in 1996.

“Oscar Stetiner owned, or at least had superior ownership of, the painting prior to its illegal seizure,” the judge said, adding, “He never voluntarily relinquished the painting,” according to the Times.

The defendants “fail to raise any material factual issues and have not presented any evidence that anyone other than Mr. Stettiner owns the painting or that Mr. Stettiner voluntarily relinquished the painting,” it added.

Evidence supporting this decision reportedly included records suggesting that Stetiner lent the painting for an exhibition in Venice in 1930, as well as a 1946 French court ruling in which Stetiner applied for ownership of the painting after World War II.

A French court is said to have ruled that the painting should be returned to Stetiner, but by that time the work had already been sold and was not returned.
